INTRODUCTION AND ACCEPTANCE OF TERMS:
Welcome to DOEL OTT, a subscription-based digital streaming platform owned and operated by Enigma Multimedia Limited, duly incorporated under the laws of Bangladesh, having its office address at Police Plaza Concord, Tower-1 (5th Floor), Plot-02, Road-144, Gulshan-1, Dhaka-1212, Bangladesh (“DOEL”, “we”, “our”, or “us”).
DOEL OTT provides users with access to movies, web series, television dramas, music videos, live programs, documentaries, and other audio-visual entertainment content (collectively, the “Content”) streamed over the internet through compatible devices, including mobile phones, tablets, computers, smart televisions, and other internet-enabled devices (collectively, the “Supported Devices”).
These Terms & Conditions (“also referred to as the “Terms of Use or the Terms”) govern and regulate your access to and use of the DOEL OTT platform, including the website, mobile applications, smart TV applications, features, functionalities, user interfaces, recommendations, subscriptions, promotional offers, and all related services provided by DOEL OTT (collectively, the “Services”).
By accessing, browsing, registering for, subscribing to, or otherwise using the Services, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms, as amended or updated from time to time. If you do not accept or agree with any provision of these Terms, you must refrain from accessing or using the Services.

All rights not expressly granted under these Terms are reserved by DOEL OTT and/or its licensors. Except for the limited, revocable, non-exclusive, non-transferable right granted to users for personal and non-commercial use of the Services, no right, title, license, or interest in or to the Services, Platform, or Content is granted or transferred to users.
Users acknowledge and agree that they shall not acquire any ownership rights in the Services or Content by virtue of accessing or using the platform. Any unauthorized use, reproduction, copying, downloading, recording, modification, distribution, transmission, broadcasting, public display, public performance, sale, rental, sublicensing, exploitation, reverse engineering, decompilation, or circumvention of any security or technological protection measures (including DRM) relating to the Services or Content is strictly prohibited. DOEL OTT reserves the right, at its sole discretion, to remove, disable access to, or block any Content upon receipt of valid copyright infringement claims or notices, or where required under applicable law, without prior notice. Violation of this clause may result in suspension or termination of user accounts and may also give rise to civil and/or criminal liability under applicable laws.
License and Permitted Use of Services:
a) You may view pages from our Website and access the Services through Supported Devices. Except as expressly permitted under these Terms, you must not copy, download, reproduce, or otherwise store any Content or materials from our Website or Services on your computer or any other device. Content may be protected by Digital Rights Management (DRM). Users must not attempt to bypass, decode, record, or extract streaming content using any tools or technology.
b) You may only use our Services for your own personal, lawful, and non-commercial purposes. Any use of the Services for commercial, promotional, or unauthorized distribution purposes is strictly prohibited.
c) Videos and Content offered as part of the Services may be viewed solely for personal or household use. Organized, public, or commercial showings are not permitted without prior written consent from Enigma Multimedia Limited, operating under the brand name DOEL OTT.
d) All Content and materials on our Website and Services are copyright-protected. You may not:
• Republish material from our Website or Services (including republication on another website).
• Sell, rent, or sub-license Content or materials.
• Display any Content publicly without authorization.
• Exploit Content or materials for commercial purposes.
• Redistribute Content or materials in any form.
We reserve the right, at our sole discretion, to restrict access to any part of our Website or Services at any time, for any reason or no reason. You must not circumvent, bypass, or attempt to circumvent or bypass any access restriction measures implemented on our Website or Services.
Restrictions of Usage
You must not use our Website, App, or Services in any manner that:
• Causes or may cause damage to, or impairs the performance, availability, or accessibility of the Website, App, or Services.
• Is unlawful, illegal, fraudulent, harmful, or connected with any unlawful, illegal, fraudulent, or harmful purpose or activity.
• Involves copying, storing, hosting, transmitting, publishing, or distributing any material containing spyware, viruses, trojan horses, worms, keystroke loggers, rootkits, or other malicious software.
• Conducts systematic or automated data collection activities (including scraping, data mining, data extraction, or data harvesting) without our express written consent.
• Accesses or interacts with our Website or App using robots, spiders, or other automated means.
• Uses data collected from our Website or App for direct marketing activities (including email, SMS, telemarketing, or direct mailing).
• Uses data collected from our Website or App to contact individuals, companies, or other entities without authorization.
• You must ensure that all information you provide to us through our Website, App, or Services is true, accurate, current, complete, clear, and not misleading.
Fair Use
The copyright laws of Bangladesh recognize the principle of “fair use” of copyrighted works, under which certain acts do not constitute infringement, including but not limited to criticism, commentary, and review of content. Content available on our Services may contain excerpts of copyrighted works which we believe, in good faith, are protected under fair use for purposes permitted by law. We may create and upload transformative videos incorporating short excerpts from longer works such as songs, movies, television shows, video games, and other audio‑visual materials. Such use is accompanied by original research, editorial commentary, and added voice‑over, ensuring that the resulting work is additive, promotional, and non‑substitutive of the original. We do not publish or distribute full‑length original works, and our transformative use is intended solely for lawful purposes consistent with fair use principles.
LEGAL CAPACITY; CHILDREN AND MINORS:
The Services are available only to individuals who are capable of entering into legally binding contracts under applicable laws. By accessing, registering for, subscribing to, or using the Services, you represent and warrant that:
a) you are at least eighteen (18) years of age, or have obtained the consent and supervision of a parent or legal guardian where permitted under applicable law. DOEL OTT may provide parental control tools, content filters, and PIN protection for age-restricted content.
b) you are legally competent and otherwise capable of entering into binding agreements under the laws of Bangladesh or any other applicable jurisdiction; and
c) you are not prohibited, restricted, or otherwise barred under any applicable law from accessing, subscribing to, or using the Services.
d) Users under the age of eighteen (18) may access the Services only under the supervision and responsibility of a parent or legal guardian. Certain Content may be subject to age classifications or parental control restrictions, and DOEL OTT reserves the right to restrict access to such Content in accordance with applicable laws, internal policies, or content rating standards.
SUBSCRIPTION & MEMBERSHIP
a) DOEL OTT operates on a subscription-based model, with certain limited content available free of charge. Subscription plans may vary in duration, pricing, features, and accessibility.
b) Your DOEL OTT subscription will continue as specified in the selected plan until terminated or cancelled in accordance with these Terms. To access the DOEL OTT Service, you must have internet access, a compatible DOEL OTT-ready device, and provide a current, valid, and accepted payment method (“Payment Method”), which may be updated from time to time through your account settings.
c) Unless you cancel your subscription before the applicable renewal date or disable the auto-renewal option (where available), you authorize DOEL OTT to automatically charge the applicable subscription fee for the next billing cycle to your Payment Method.
d) You may review the details of your subscription plan, billing cycle, renewal date, and payment information by accessing the “My Account”, “Subscription”, or equivalent section within the DOEL OTT Website or Mobile Application.
e) DOEL OTT reserves the right to modify subscription plans, pricing, features, or benefits at any time upon reasonable prior notice to users, subject to applicable laws and regulations.
f) Failure to successfully process payment may result in suspension or termination of access to subscription-based content and services until payment is successfully completed.
TRANSACTIONAL VIDEO ON DEMAND (TVOD)
a) In addition to its subscription-based services, DOEL OTT may offer selected content on a Transactional Video on Demand (“TVOD”) basis, allowing users to rent or purchase individual movies, series, or special events for a one-time fee.
b) Upon purchasing TVOD content, you are granted a limited, non-exclusive, non-transferable license to view the specified content solely for personal and non-commercial use. TVOD content is accessible only through the account used for purchase and on compatible DOEL OTT-supported devices linked to that account.
c) Access to TVOD content is limited to a specified viewing period (e.g., 7 or 30 days from first playback or as stated at the time of purchase), after which access shall automatically expire. A TVOD purchase does not entitle you to access DOEL OTT’s full subscription library or other subscription-based content.
d) Each TVOD transaction requires separate payment, and applicable taxes and fees will be disclosed at the time of purchase. Unless otherwise required by law or in cases of verified technical errors or accidental duplicate charges, all TVOD purchases are final and non-refundable.
e) TVOD availability may vary based on geographic location, licensing restrictions, device compatibility, device limitations (e.g., access on 1 to 4 devices), and technical limitations. DOEL OTT reserves the right to modify, restrict, or remove TVOD content at any time in accordance with licensing requirements or operational needs.
f) Users are strictly prohibited from copying, recording, sharing, redistributing, reselling, or otherwise misusing TVOD content. Unauthorized use, fraud, or violation of these Terms may result in suspension or termination of access and/or legal action.
AD-SUPPORTED CONTENT AND THIRD-PARTY ADVERTISEMENTS
a) DOEL OTT may offer certain content or subscription plans on an ad-supported basis, and the platform or content may include advertisements, sponsored content, or links to third-party websites, applications, or services.
b) Such third-party advertisements, promotions, or external links are provided for convenience only. DOEL OTT does not control, endorse, verify, or assume responsibility for any third-party content, products, services, or websites displayed or made accessible through the platform.
c) Any interaction, engagement, purchase, or correspondence between users and third-party advertisers or service providers is solely between the user and the respective third party. DOEL OTT shall not be liable for any loss, damage, claim, or dispute arising from such interactions.
d) Third-party websites or services accessed through DOEL OTT are governed by their own terms of use and privacy policies, and users are advised to review them independently before engaging with such services.
e) DOEL OTT shall not be responsible or liable, directly or indirectly, for any content, accuracy, legality, or practices of any third-party websites, advertisements, or services, even where such links or content are made available through the DOEL OTT platform.
STREAMING POLICY
Streaming access to DOEL OTT content is permitted only within the country or region from which the user has subscribed or registered the account. Use of VPNs, proxies, or location-masking tools to bypass geo-restrictions is strictly prohibited and may result in suspension or termination of account. For example, if a subscription is purchased from Bangladesh, the content may be streamed only within Bangladesh. The availability, access, and scope of content or services on DOEL OTT, whether in whole or in part, shall be subject to DOEL OTT’s sole discretion and may vary depending on geographical location, licensing agreements, technical limitations, or regulatory requirements. DOEL OTT does not guarantee that all users will have access to the same content library or service features, and content availability may differ across regions and over time.
FREE CONTENT & FREE TRIAL
a) DOEL OTT may, at its sole discretion, offer selected content free of charge or provide promotional access for a limited period, including free trials of subscription plans. The duration, eligibility, and conditions of any free trial or free access shall be determined by DOEL OTT and communicated at the time of sign-up or access.
b) Eligibility for free trials is determined by DOEL OTT at its sole discretion and may be restricted to prevent abuse. DOEL OTT reserves the right to verify eligibility using criteria such as device information, geolocation, payment method, or account history, and may revoke or suspend free trial access where misuse or ineligibility is identified.
c) Unless cancelled or upgraded before the end of the free trial period, the user’s selected subscription plan (if applicable) will automatically commence, and the applicable subscription fee will be charged to the user’s payment method.
d) DOEL OTT reserves the right to modify, restrict, or withdraw any free content or promotional access at any time without prior notice, and to convert free content into paid subscription content at its discretion.
PROMOTIONAL OFFERS
From time to time, DOEL OTT may provide promotional offers, special plans, discounts, or membership benefits (collectively referred to as “Offers”). Eligibility for such Offers shall be determined solely at the discretion of DOEL OTT, and we reserve the right to modify, withdraw, or revoke any Offer, or suspend access to an account, if we determine that eligibility criteria have not been met or that there has been misuse of the Offer.
Introductory or promotional Offers may not be available to users with an existing or recent DOEL OTT subscription. Eligibility may be assessed using factors such as device information, payment method, geolocation, or email address associated with prior accounts. Any specific terms, conditions, or limitations applicable to an Offer will be disclosed at the time of promotion or sign-up.
SUBSCRIPTION PLANS
Users may view details of available subscription plans, including pricing, features, and billing information, at any time through the DOEL OTT website or mobile application by accessing the “Subscribe Now”, “View Plans”, or equivalent section available on the platform or within the application menu.
PAYMENT AND BILLING
a) Subscription fees for DOEL OTT and any other charges related to your use of the Service, including applicable taxes and transaction fees, shall be charged in advance to your selected and approved payment method (such as mobile financial services, debit/credit cards, or third-party payment gateways) at the time of subscription activation and on each subsequent renewal date, where applicable.
b) The billing cycle shall commence on the date of activation of the paid subscription and shall automatically renew on a periodic basis unless cancelled prior to the renewal date. In certain cases, billing dates may vary due to payment processing cycles, failed transactions, or differences in calendar months. Users may view their next billing date through their account or subscription settings within the DOEL OTT platform.
c) Users are required to maintain at least one valid payment method on their account. If a payment is not successfully processed due to expiration, insufficient funds, or other reasons, DOEL OTT may suspend or restrict access to the Service until a valid payment method is provided and outstanding dues are settled.
d) By updating or replacing a payment method, the user authorizes DOEL OTT to charge the updated payment method for any outstanding or future subscription fees, and remains responsible for all unpaid amounts associated with the account.
e) Certain payment providers may impose additional charges, such as foreign transaction fees or processing fees, which are governed by the respective payment provider. DOEL OTT shall not be responsible for such charges.
f) All payments are non-refundable, except in cases of duplicate billing, erroneous transactions, or where required under applicable law, as determined by DOEL OTT upon verification.
g) The subscriber will be entitled to get access to his paid account and utilize the service right away upon successful payment of his selected plan.
AUTOMATIC RENEWAL & CANCELLATION POLICY
a) By subscribing to DOEL OTT, you agree that your subscription will automatically renew at the end of each billing cycle using the payment method selected by you, including but not limited to mobile financial services (e.g., bKash, Nagad), debit/credit cards, or other supported payment gateways, unless auto-renewal is cancelled in advance.
b) Unless cancelled prior to the renewal date, the applicable subscription fee for the next billing cycle will be automatically charged to your selected payment method. You authorize DOEL OTT to process such recurring payments to ensure uninterrupted access to the Service.
c) To avoid being charged for the next billing cycle, you must cancel your subscription at least twenty-four (24) hours prior to the renewal date. Failure to cancel within this timeframe will result in automatic renewal and charging of the applicable fee, which may be non-refundable.
d) You may cancel your subscription at any time through your account settings or by contacting DOEL OTT Support. Upon cancellation, you will continue to have access to the Service until the end of your current billing period, after which your subscription will automatically terminate.
e) You can request cancellation by contacting DOEL OTT Support via phone or email (support@doelbd.com, +880 9678 123000).
f) If payment is not successfully processed due to expiration, insufficient funds, or any other reason, DOEL OTT may suspend or restrict access to the Service until a valid payment method is provided or outstanding dues are settled.
g) If you subscribed through a third-party platform or payment provider, cancellation may need to be completed directly through that provider in accordance with their terms, and DOEL OTT shall not be responsible for third-party billing or cancellation processes.
h) All payments are non-refundable, and DOEL OTT does not provide refunds or credits for partial subscription periods, unused time, or unwatched content, except in cases of duplicate billing or verified technical errors.
i) DOEL OTT reserves the right to modify, update, or revise this policy at any time. Any changes will be effective upon publication on the DOEL OTT platform or application.
CHANGES TO SUBSCRIPTION PLANS AND PRICING
DOEL OTT reserves the right to modify, update, or discontinue subscription plans and to adjust the pricing of its services from time to time at its sole discretion. Any changes to subscription plans or pricing shall become effective only upon the commencement of the next billing cycle or upon renewal of the existing subscription and shall not affect an ongoing active subscription period. Where required by applicable law or platform policy, DOEL OTT may provide advance notice of such changes through the platform, application, or other reasonable communication channels. If you do not agree to the revised pricing or subscription plan, you may cancel your subscription before the changes take effect. Continued use of the DOEL OTT service after the changes become effective shall constitute acceptance of the updated pricing or subscription plan.
SERVICE OR SUBSCRIPTION RETURN
Once you purchase a subscription or get subscribed to the DOEL OTT paid account plan, we do not accept returns of the subscription or provide refunds for subscription fees, and this applies to all types of subscription plans. If you no longer wish to continue with the DOEL OTT paid subscription plan, you may cancel or unsubscribe from your DOEL OTT subscription at any time in accordance with the applicable cancellation policy.

REFUND POLICY
a) All payments made for DOEL OTT services are generally final and non-refundable, except as expressly provided in this Policy or where required under applicable law.
b) DOEL OTT does not provide refunds or credits for:
• Partial Use of the Service
• change of mind
• unused subscription periods
• unwatched content
• account inactivity during an active subscription period
c) Refunds may be considered only in limited circumstances, including:
• duplicate transactions
• incorrect, unauthorized, or erroneous charges
d) All refund requests must be supported by valid documentation and submitted to DOEL OTT Support for verification. DOEL OTT reserves the right to approve or reject any refund request after due review.
e) Where a refund is approved, it shall be processed within ten (10) working days and credited to the original payment method used for the transaction, subject to processing times of banks or payment providers.
f) DOEL OTT reserves the right to modify, update, or amend this Refund Policy at any time. Any changes will take effect upon publication on the DOEL OTT platform or application.

DOEL OTT SERVICE
a) Users may create an account on DOEL OTT by signing up through their Facebook account or by using their mobile number. DOEL OTT will create an account based on the login information provided by the user. Once the account is created, the user may be redirected to the subscription page to complete the subscription process, where applicable. To maintain control over the account and prevent unauthorized access (including access to viewing history and account information), the Account Owner is responsible for maintaining the security of the DOEL OTT-ready devices used to access the service and for not disclosing the account password or payment method details to any third party. Users are responsible for updating and maintaining accurate and current information relating to their account. DOEL OTT reserves the right to suspend, place on hold, or terminate any account in order to protect the user, DOEL OTT, or its partners from identity theft, fraudulent activity, unauthorized use, or other security concerns.
b) The DOEL OTT Service and all Content made available through the platform are provided solely for personal and non-commercial use. DOEL OTT grants you a limited, non-exclusive, non-transferable right to access and stream Content during your active subscription through Supported Devices. No ownership, title, or intellectual property rights are transferred to you under these Terms, except for the limited usage rights expressly granted herein.
c) You agree to use the Service strictly in accordance with these Terms and applicable laws. You shall not copy, reproduce, distribute, transmit, publicly display, modify, sell, rent, sublicense, or otherwise exploit any Content or part of the Service, except as expressly permitted. Any unauthorized use of the Service or Content may result in suspension or termination of your account and legal action where applicable.
d) Access to Content is subject to geographic and licensing restrictions. The availability of Content may vary depending on your location and may change from time to time due to licensing agreements, regulatory requirements, or technical limitations. DOEL OTT does not guarantee uniform access to all Content across all regions.
e) DOEL OTT continuously updates and modifies its Service, including user interface, features, Content library, and system functionalities. Such updates may be applied automatically without prior notice to improve performance, security, and user experience.
f) The Service is designed for use on Supported Devices; however, DOEL OTT does not guarantee uninterrupted or uniform performance across all devices. Performance, quality, and accessibility may vary depending on device specifications, operating system, network conditions, and internet speed. It is your responsibility to ensure that your device meets the minimum technical requirements for accessing the Service. DOEL OTT shall not be liable for any service interruption or performance issues arising from device incompatibility, third-party software limitations, or manufacturer restrictions.
g) The DOEL OTT software may be updated from time to time, and by using the Service, you consent to receive such updates automatically. The Service may also include links or integrations with third-party applications, websites, or services. DOEL OTT does not control or endorse such third-party services and shall not be responsible for their content, availability, or practices. Users are advised to review the terms and privacy policies of any third-party services before use.
h) You are solely responsible for maintaining the confidentiality and security of your account credentials and for all activities conducted through your account. You agree to immediately notify DOEL OTT of any unauthorized access or security breach. You are responsible for all activity occurring under your account, whether or not authorized by you, including access by any other person.
i) A single account may be accessed by multiple users only as permitted under the applicable subscription plan. You remain fully responsible for ensuring compliance with these Terms by all users accessing your account, and DOEL OTT reserves the right to limit, restrict, or suspend access where account usage violates fair usage principles or subscription conditions.
j) Access to the DOEL OTT Service may be subject to limitations on the number of simultaneous streams, registered devices, profiles, or concurrent users depending on the applicable Subscription Plan. Users shall not share account credentials outside their household or in a manner inconsistent with fair usage practices or the applicable Subscription Plan. DOEL OTT reserves the right to monitor account usage patterns and may suspend, restrict, or terminate accounts involved in unauthorized sharing, excessive concurrent streaming, abuse of device limitations, or other suspicious activity.
PRIVACY AND DATA PROTECTION

DISCLAIMERS OF WARRANTIES
The DOEL OTT Service, including all content, software, features, functionalities, and related services, is provided on an “as is” and “as available” basis without warranties, representations, or guarantees of any kind, whether express or implied. DOEL OTT does not warrant that the Service will be uninterrupted, secure, error-free.
DOEL OTT shall not be responsible for any interruption, delay, failure, or damage resulting from internet connectivity issues, device incompatibility, technical malfunctions, software limitations, payment gateway failures, unauthorized access, or circumstances beyond its reasonable control.
You acknowledge and agree that DOEL OTT shall not be responsible or liable for any defamatory, offensive, unlawful, infringing, or objectionable conduct, content, or activities of any third party, and that any risk arising from such content or conduct shall remain solely with the user.
The Service may be subject to interruptions, delays, and limitations inherent to internet and electronic communications. DOEL OTT shall not be liable for any delays, streaming failures, delivery failures, or damages resulting from such technical limitations or device-related issues. Where any warranty, condition, or liability cannot be excluded or limited under applicable law, DOEL OTT’s liability shall be limited to the maximum extent permitted by such law.
INDEMNITY AND LIMITATION OF LIABILITY
You agree to indemnify, defend, and hold harmless DOEL OTT, its parent company, affiliates, directors, officers, employees, licensors, partners, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees and expenses) arising out of or related to:
a) your use or misuse of the Service;
b) your violation of these Terms or applicable laws and regulations; or
c) your infringement of any rights of any third party.
To the fullest extent permitted under applicable law, DOEL OTT, its parent company, affiliates, directors, officers, employees, licensors, partners, and agents shall not be liable for any direct, indirect, incidental, special, punitive, exemplary, or consequential damages, losses, costs, or expenses arising out of or in connection with:
(i) any errors, inaccuracies, or omissions in content;
(ii) any interruption, delay, suspension, or unavailability of the Service;
(iii) any unauthorized access to or use of servers, systems, accounts, or stored information;
(iv) any viruses, malware, bugs, trojan horses, or other harmful components transmitted through the Service by any third party;
(v) any personal injury, property damage, data loss, business interruption, or financial loss arising from the use of or inability to use the Service; or
(vi) any content made available, transmitted, or otherwise accessed through the Service, whether based on warranty, contract, tort, negligence, strict liability, or any other legal theory, even if DOEL OTT has been advised of the possibility of such damages.
To the maximum extent permitted under applicable law, the aggregate liability of DOEL OTT arising out of or relating to the Service or these Terms shall not exceed the total amount paid by the user to DOEL OTT for the applicable subscription or service during the twelve (12) months immediately preceding the event giving rise to the claim. MISCELLANEOUS
a) Governing Law: These Terms & Conditions shall be governed by, construed, and enforced in accordance with the laws of the People’s Republic of Bangladesh.
b) Legal Remedies and Enforcement: Without prejudice to any other rights or remedies available under applicable law or equity, DOEL OTT reserves the right to take appropriate legal action against any user for any violation, breach, misuse, unauthorized access, infringement, fraudulent activity, or unlawful conduct relating to the Service, Content, Platform, or these Terms & Conditions.
c) Unsolicited Submissions: DOEL OTT does not accept unsolicited creative materials, ideas, suggestions, scripts, concepts, proposals, or other submissions relating to content, programming, productions, or business operations. DOEL OTT shall not be responsible for any similarity between any unsolicited submission and any existing or future content, programming, productions, or materials developed independently by DOEL OTT or its affiliates, partners, licensors, or content creators.
d) Feedback and Suggestions: DOEL OTT welcomes feedback, comments, and suggestions for improvements to its services. Users may submit feedback through DOEL OTT’s official customer support channels or designated communication platforms. By submitting any feedback, ideas, comments, recommendations, or suggestions, you grant DOEL OTT a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable, and sublicensable right to use, reproduce, modify, adapt, publish, distribute, and incorporate such feedback into its services, products, business operations, or promotional activities without restriction, acknowledgment, or compensation.
e) Electronic Communications: By using the Service, you consent to receive communications from DOEL OTT electronically, including but not limited to account notifications, payment confirmations, invoices, password reset notifications, service updates, subscription notices, promotional communications, policy changes, and legal notices. Such communications may be provided through email, SMS, push notifications, in-app notifications, website notices, or other electronic means using the contact information associated with your account. Electronic communications shall satisfy any legal requirement that such communications be in writing.
f) Amendments to Terms & Conditions: DOEL OTT reserves the right to modify, amend, revise, update, or replace these Terms & Conditions at any time at its sole discretion. Any revised Terms shall become effective immediately upon publication for new users and upon reasonable notice for existing users, unless otherwise required by law. Where material changes are made, DOEL OTT may provide advance notice through the platform, email, SMS, push notification, or other reasonable communication methods. Your continued access to or use of the Service after such changes become effective shall constitute your acceptance of the revised Terms. If you do not agree with the updated Terms, you must discontinue use of the Service.
g) Severability: If any provision of these Terms & Conditions is determined by a competent court or authority to be invalid, illegal, unlawful, void, or unenforceable, such provision shall be deemed severed or modified to the minimum extent necessary, and the remaining provisions shall remain valid, binding, and enforceable to the fullest extent permitted by law.
h) Entire Agreement:These Terms & Conditions, together with the Privacy Policy and any additional policies, notices, guidelines, or legal documents published by DOEL OTT, constitute the complete and entire agreement between you and DOEL OTT regarding your access to and use of the Service and supersede all prior or contemporaneous understandings, communications, representations, or agreements, whether oral or written, relating to the subject matter herein.
i) Waiver: No failure or delay by DOEL OTT in exercising any right, remedy, power, or privilege under these Terms & Conditions shall operate as a waiver thereof. Any waiver by DOEL OTT shall be effective only if made in writing and shall not constitute a continuing waiver of any subsequent breach or default.
j) Assignment: You may not assign, transfer, sublicense, or otherwise dispose of your rights or obligations under these Terms & Conditions without the prior written consent of DOEL OTT. DOEL OTT may assign, transfer, delegate, or subcontract its rights and obligations under these Terms & Conditions, in whole or in part, without restriction or prior notice to users. These Terms & Conditions shall be binding upon and inure to the benefit of the parties and their respective successors, permitted assigns, and legal representatives.
k) Notices: DOEL OTT may provide notices to users through email, SMS, push notifications, website postings, in-application notifications, or other reasonable communication methods using the contact information associated with the user account. Notices sent electronically shall be deemed received on the date of transmission unless otherwise prohibited by applicable law.
l) User Communications and Preferences: Users acknowledge and agree that DOEL OTT may send communications relating to accounts, subscriptions, payments, security alerts, updates, promotional offers, and service-related matters electronically through the contact details provided during registration or account management. Users may manage certain communication preferences through their account settings where applicable.
m) Class Action Waiver: To the fullest extent permitted by applicable law, you and DOEL OTT agree that any dispute, claim, or proceeding arising out of or relating to the Service or these Terms shall be brought solely in an individual capacity and not as part of any class action, consolidated action, representative proceeding, or collective claim. Neither party shall participate in or initiate any class arbitration, class action lawsuit, or representative proceeding against the other unless otherwise required under applicable law.
n) Force Majeure: DOEL OTT shall not be liable or responsible for any failure or delay in performance arising out of or caused by, directly or indirectly, forces beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, governmental actions, labor disputes, internet or telecommunications failures, power outages, equipment breakdowns, civil disturbances, or war. In such cases, DOEL OTT’s obligations shall be suspended for the duration of the event, and DOEL OTT shall make reasonable efforts to resume performance as soon as practicable.
